Background
In one of his first acts as President, Donald Trump issued Executive Order 13771, requiring that for each new regulation his administration promulgates, two must be removed. This order morphed into a requirement that “the total incremental cost of all new regulations, including repealed regulations, to be finalized this year shall be no greater than zero.”
Impact to Hunters
Although most pro-hunting “regulations” (like opening land to hunting) would be “deregulatory,” hunters were concerned that opening areas to hunting could be caught up in these prohibitions if any costs were involved. Sportsmen’s Alliance filed comments on the interim guidance implementing the order to request clarification from the White House Office of Management and Budget that any “regulations” that open up recreational activities on federal land are exempt from the “one-in, two-out” and net dollar impact provisions in the Executive Order.
Result
The White House 0MB took the comments into consideration and issued new guidance on implementing the Executive Order that makes clear that opening areas to hunting would not be an action subject to the new procedures. The guidance specifically protects “routine hunting and fishing regulatory actions” from the offset requirement.
