On Monday, May 6, Governor Kay Ivey signed SB 281, the Second Amendment Financial Privacy Act, into law. Alabama joins a growing list of states taking proactive measures to protect the credit card purchase privacy of its sportsmen.
SB 281 prohibits a financial institution from requiring merchants to use a merchant category code (MCC) or any other indicator to distinguish a firearms retailer from a general merchandise retailer or a sporting goods retailer. SB 281 further protects sportsmen by authorizing the Attorney General to investigate alleged violations of this act, enforce this act by bringing an action to recover civil penalties, and restrain and enjoin an individual or entity from violating this act.
