On Thursday, January 29, the House unanimously passed SB 2A, a “proactive” deregulation measure designed to align state law with potential future federal changes regarding firearm suppressors. The bill will now be sent to Governor Larry Rhoden for his expected signature.
Key Provisions of SB 2A
SB 2A does the following:
- removes firearm silencers (suppressors) from the state’s definition of a “controlled weapon,”
- eliminates this state-level penalty for suppressors. Under current South Dakota law, possessing an unregistered controlled weapon is a Class 6 felony, punishable by up to two years in prison,
- removes the state requirement to possess a federal tax stamp to be in compliance with state law.
- ensures that if the federal government eventually removes suppressors from the National Firearms Act (NFA), South Dakotans will not remain in violation of lingering state-level regulations.
