On Wednesday, January 21, the Senate Public Safety Committee is holding a hearing on an important bill to protect the financial credit card privacy of Arizona’s sportsmen and gun owners from overreach by financial institutions and third-party data collectors. SB 1058 is scheduled to be heard at 1:30 p.m. in Senate Hearing Room 109 in Phoenix.

SB 1058, the “Second Amendment Financial Privacy Act,” should look familiar to sportsmen. It is returning from last year, where it passed the Senate and the House, and Governor Katie Hobbs vetoed it.

The primary objective of SB 1058 is to prohibit the use of specific merchant category codes (MCCs) to track firearm and ammunition purchases. This legislation is essential for several reasons:
- Preserves Privacy: Financial transactions involving legal products should not be used to create de facto registries of law-abiding gun owners. Arizona citizens expect their private purchases not to be flagged or monitored by payment networks.
- Prevents Discrimination: By prohibiting distinctive codes for firearm retailers, this bill ensures that lawful businesses and their customers are not unfairly targeted or subjected to secondary surveillance based on their exercise of a Second Amendment right.
- Prevents Government Overreach: This bill correctly bars government entities from using financial data to compile lists of firearm owners, reinforcing the principle that the state should not monitor the private, legal activities of its citizens without cause.
