Yesterday, Thursday, March 20, the New Mexico House Judiciary passed Senate Bill 318 with a “Do Pass” recommendation. SB 318 could be heard on the House floor at any time, especially with the 2025 legislative session expected to adjourn tomorrow, Saturday, March 22.
This bill is a bad policy motivated by those who simply want to destroy the sporting community because they know that if the industry cannot engage in lawful commerce, hunters and sport shooters cannot hunt and shoot. Use the Take Action button to email your state Representative and urge him/her to vote “No” on SB 318.
Senate Bill 318 creates a special cause of action for the Attorney General and even private persons “likely” to be damaged and to hold firearms manufacturers, distributors, and online marketplaces jointly liable for the violent acts of third parties, with severe penalties of $250,000 per violation.
Sadly, SB 318 strips current liability protection from manufacturers, distributors, and online marketplaces of firearms, parts, and accessories when their lawful products are used to commit a crime. This could lead to increased costs and excessive litigation while doing nothing to address the safety of the state’s public safety and violent crime rate.
