South Dakota is one of several states across the United States with a firearms preemption law. This important law protects sportsmen and gun owners by prohibiting counties, municipalities and all local governments from passing their own laws or ordinances restricting the lawful possession, transportation, sale, transfer, ownership, manufacture or repair of firearms or ammunition or their components.
Apparently, there are some Homeowners’ Associations (HOA) who think they are above this law and are trying to pass their own prohibitions and restrictions against lawful sportsmen and gun owners.
Tomorrow, Jan. 16, at 11 a.m., in room 412, the Senate Commerce and Energy Committee, is scheduled to hear Senate Bill 39.
SB 39 prohibits a homeowners’ association from placing restrictions on firearms or firearm ammunition.
