Ruling declines preliminary injunction to halt Montana wolf harvest but the lawsuit will continue
The 1st Judicial District Court of Montana rejected an attempt by animal-rights groups to stop the state’s 2025-26 wolf harvest. On December 19, the court ruled that the plaintiffs did not show the state’s method of estimating its wolf population would cause irreparable injury to the population.
Even after Congress recognized that the wolves were recovered and removed federal Endangered Species Act protections in 2011, Montanans still find themselves at the center of litigation. This latest saga concerns several animal extremists’ attempts to stop Montana’s science-based wolf harvest.
The Dispute Over the iPOM Population Model
The lawsuit, filed in October 2022, takes issue with Montana’s integrated patch occupancy model (iPOM), the method Montana uses to estimate its wolf population. Like all wildlife population estimators, iPOM takes different sources of wolf population data and then estimates the total number of wolves.
The plaintiffs primarily argue that because one of the inputs is hunter surveys, iPOM overestimates the true number of wolves, and any harvest quota using iPOM would reduce the wolf population too much.
What Comes Next in the Legal Battle?
This is not the end of litigation in this case. This ruling denied a preliminary injunction, a temporary measure to maintain the status quo while litigation continues. The court will still have a full trial to determine the future of iPOM and wolf harvests.
There is also separate federal litigation attempting to relist these wolves under the Endangered Species Act. That could also deprive the state of the ability to hold a wolf hunt. Sportsmen’s Alliance Foundation intervened in that lawsuit and was the first party to appeal it to the Ninth Circuit.
